REGULAR COUNCIL MEETING AGENDA

That the attached minutes of the regular Council meeting held December 16, 2019 and the budget Council meeting held January 6, 2020, be adopted as read on this day and that such minutes as read set out all of the business before Council at those meetings and fully and properly record all of the resolutions and bylaws passed and adopted by Council at those meetings.

That Council AMENDS the agenda to move agenda item F.5: 2020 Canadian Native Fastball Championships to be considered immediately following agenda item C.2: Delegation - 2020 Canadian Native Fastball Championships Organizing Committee.

That Council RECEIVES FOR INFORMATION the report dated January 14, 2020 from the General Manager of Planning and Development titled ”Monthly Building Permit and Development Permit Summary (December 2019)".

That the Formal Public Hearing regarding "Ross McBride Crescent Road Closure Bylaw No. 9060, 2019", BE CLOSED.

That the Formal Public Hearing regarding "Amendment to the City of Prince George Zoning Bylaw No. 7850, 2007 (Rezoning Application No. RZ100627, Amendment Bylaw No. 9041)", BE CLOSED.

That Council RECEIVES FOR INFORMATION the report dated January 10, 2020 from Mayor Lyn Hall titled “2019 Year in Review.”

That Council RECEIVES FOR INFORMATION the report dated January 10, 2020 from the City Manager, titled “Engineering Services Year 2020 Budget Increase”.

That Council APPROVES the Environmental Services Service Enhancement - Climate Change and Energy Coordinator Position.

That Council APPROVES the revised Terms of Reference for the Select Committee on a Safe, Clean and Inclusive Downtown attached as Appendix “A” to the report dated January 9, 2020, to include the Prince George Business Owners Advocacy Group as one of the Community Organizations which is eligible to form the membership of this Committee.

That Council:

1. APPROVES financial support of the 2020 Canadian Native Fastball Championship of up to $26,300 to cover City of Prince George facility rental and services costs and that the funds come from the Major Events Reserve; and
2. APPROVES financial support of the 2020 Canadian Native Fastball Championship of up to $21,833 to cover the one-time purchase costs of a Portable Backstop and Fencing required to adapt ball fields to meet specific standards of major event hosting and that the funds come from the Major Events Reserve.

That Council RECEIVES FOR INFORMATION the report dated January 3, 2020, from the Director of Community Services and Public Safety, titled “Prince George Events Group – 2020 Major Sport & Special Events.”

That Council APPROVES camping at Exhibition Park for the 2020 Cariboo Rocks The North concert event on August 7 to 9.

That Council GIVES FIRST AND SECOND READINGS to "City of Prince George 1445 Dogwood Street Road Closure Bylaw No. 9061, 2019".

Remedial Action:

1.  THAT Council, under the authority provided in Section 73 of the Community Charter and after viewing the photographs of the property provided in the staff PowerPoint presentation, declares that the structure located on the property at 1103 Chilako Avenue, Prince George, having a legal description of: Lot 354 District Lot 936 Cariboo District Plan 15185 (Parcel Identifier: 012-050-245) is in an unsafe condition that requires remedial action to demolish and remove the damaged structure and level the site, in order to eliminate the unsafe condition.

2.  AND FURTHER THAT Council, pursuant to the authority provided in Section 74 of the Community Charter and after viewing the photographs of the property provided in the staff PowerPoint presentation, declares that the structure and yard located on the property at 1103 Chilako Avenue, Prince George, having a legal description of: Lot 354 District Lot 936 Cariboo District Plan 15185 (Parcel Identifier: 012-050-245) is so dilapidated as to be offensive to the community and, as a result, is a declared nuisance that requires remedial action to clean up the property and demolish and remove the damaged structure and level the site, in order to eliminate the nuisance.

3.  AND FURTHER THAT Council imposes the following remedial action requirements on Harjinder John Singh BERAR, and Spuran Kaur SIDHU, as the registered owners of the property at 1103 Chilako Avenue, Prince George, having a legal description of: Lot 354 District Lot 936 Cariboo District Plan 15185 (Parcel Identifier: 012-050-245) with respect to the structure and property noted above in Recommendations 1 and 2:

• to demolish the damaged structure;
• to remove all debris from the yard including from the demolition of the structure to an appropriate disposal site; and
• level the site;

in order to eliminate the unsafe condition and declared nuisance.

Compliance and Reconsideration Notice Time Limit Recommendations:

4.  AND FURTHER THAT Council, pursuant to Section 76 of the Community Charter, sets the time limit for completion of all the remedial action requirements described in Recommendation 3, to be no later than 5:00 p.m. on February 28th, 2020.

5.  AND FURTHER THAT Council, pursuant to Section 78 of the Community Charter, sets the time limit for giving notice of a request for Council to reconsider the remedial action requirements described in Recommendation 3, to be no later than 5:00 p.m. on February 5th, 2020.

Municipal Action at Defaulter's Expense

6.  AND FURTHER THAT Council authorizes Administration to take all appropriate action in accordance with Section 17 [Municipal Action at Defaulter’s Expense] of the Community Charter to ensure the subject property is brought into compliance with all the remedial action requirements described in Recommendation 3, provided that:

1. the property owner has not fully completed the remedial action requirements on or before the time limit specified in this Council resolution; and

2. all costs incurred by the City to bring the property into compliance shall be at the expense of the property owner and, pursuant to Section 17 of the Community Charter, such costs shall be recovered from the property owner as a debt owed to the City of Prince George.

That Council GIVES FIRST AND SECOND READINGS to “City of Prince George Zoning Bylaw No. 7850, 2007, Amendment Bylaw No. 9079, 2019”.

THAT an alternative approval process in accordance with section 86 of the Community Charter be used for the purpose of seeking approval of the electors in relation to City of Prince George Equipment Financing Bylaw No. 9104, 2020.

THAT Council establishes the deadline of 5:00 p.m. on Tuesday, March 10, 2020 for receiving Elector Response Forms for the alternative approval process for City of Prince George Equipment Financing Bylaw No. 9104, 2020.

THAT Council approves the determination of the total number of electors of the area to which the alternative approval process apply for City of Prince George Equipment Financing Bylaw No. 9104, 2020 as 58,455 electors, on the basis described in this report.

THAT Council directs the Corporate Officer to report the results of the alternative approval process for City of Prince George Equipment Financing Bylaw No. 9104, 2020 and if approval of the electors has been obtained, to return City of Prince George Equipment Financing Bylaw No. 9104, 2020 for Council’s consideration of final reading and adoption.

That Council GIVES FIRST THREE READINGS to “City of Prince George Comprehensive Fees and Charges Bylaw No. 7557, 2004, Amendment Bylaw No. 9101, 2019”.

That Council GRANTS FINAL READING AND ADOPTION to "City of Prince George Preston Road Closure Bylaw No. 9039, 2019."

That Council GRANTS FINAL READING AND ADOPTION to "City of Prince George 2224 Queensway Road Closure Bylaw No. 9068, 2019."
